What is a partition action?
A partition action is a lawsuit one co-owner of a property files asking a court to either physically divide the property or, more commonly for a single house, order it sold and the proceeds divided among the owners. It is used when co-owners cannot agree on selling or keeping jointly held property. Brian and a real estate attorney can usually find a negotiated listing agreement before a partition action becomes necessary.
