Where is my earnest money held, and can I lose it?

Earnest money is generally held in a real estate attorney's trust account until closing, rather than sitting with the seller or the agent directly. You can lose it if you walk away from the deal after all your contingencies, such as financing or inspection, have already been satisfied or waived. Brian Beatty tracks those contingency deadlines closely so a buyer's deposit stays protected throughout the transaction.
